  • Re-entry permit lost - Currently out of US - how to get back to extend ReP

I was granted ReP in Dec 2011. Unfortunately, lost it during moving my house. The airline is not allowing me to board the flight to the US now since its been more than a year I have been out of the US, and do not have the original ReP (though I have a copy). I contacted the US consulate in Mumbai, and the US embassy in Delhi. Both are unable to help, they suggest I contact the USCIS office in US to get something to replace my ReP. The USCIS office says they cant do anything unless I am present in the US. I am stuck in a vicious circle...

Additionally, I have a 16 month old son, who I wish to take along with me to the US so that I can get his GC processed. If I am not allowed to enter the US before my ReP expires, we will lose the opportunity to get a GC for my son.
Any suggestions what can be done in this situation?? I know SB-1 is an option, but if I go for it, I wont get a GC for my child. Is there anything else that can help me travel to the US? I am in status(since my ReP has not expired, just that I have the original)

You're being misled by the U.S. Embassy and Consulate. With the copy you have of the Reentry Permit, they have the authority to accept it and to issue you a temporary travel document, but they will charge a fee. Have your relatives in the U.S. ask for Congressional help to submit a Congressional request to the Consulate or Embassy which issues visas for your area of India.

I once thought I'd lost my RP while abroad, and I was told I could not get a transportation letter since it had been more than a year that I'd been outside the country. They said I could apply for a returning resident visa, and since I had been issued an RP, I'd shown my intention of maintaining ties to the US and that it was out of my control that I was out of the country for longer than a year without physical documentation of the RP. So, ask them if they can issue you the SB1 returning resident visa.

I have to agree that the Returning Resident Visa is the best option for a Green Card holder who stays outside the U.S. a year or longer, and who has previously expressed intent to retain Permanent Resident status. The "travel document" I responded about in my first response is not likely to be issued once you are out a year or more.
