  • I-90 or I-751 to replace Stolen Greencard???

    My wife's greencard was stolen out of her purse and we are trying to figure out what we should do. She had a two year card and the expiration date is in June of 2014. We need to get her a new Greencard because we are traveling out of the country in March of 2014. Instead of submitting an I-90 I was wondering if I can submit an I-751 (application to remove conditions on Greencard) prior to the 90 day mark in order to get a new Greencard. I was told that I-751's are rejected if they are submitted prior to the 90 day period by my lawyer, however I called USCIS and the guy on the phone said that the I-751 wont be rejected because it was stolen. He said we should do the following:

    1) Submit the I-751 <--the guy specifically told me it wont be rejected even though it is outside the 90 day period
    2) Schedule a meeting via infopass
    3) After submitting the I751 we will receive an I797 receipt
    4) Bring the I797 receipt to the meeting scheduled for Infopass and request an ADIT stamp for my wife's passport


    Does this sound right? Will the I751 be approved even though we are applying prior to the 90 day mark? How long does it take to receive the I797?
