  • 4 years and 1 day rule?

    I became a greencard holder on March 25, 2008.

    I left the US with a re-entry permit on May 30th 2008 to finish school in another country. I was out of the US for a little less than two years.

    I returned to the US on March 25, 2010 with my permit and have not left the US for extended periods of time ever since.

    Does the 4 year and 1 day rule apply to me? Can I submit the N-400 application for citizenship on March 26, 2014?

    My calculation shows that you can apply at 4 years and 9 months (3 months shy of the "5 year rule") on December 26, 2014.
    But the "4 years and 1-day rule" may apply to you, though this is often misinterpreted by USCIS reviewers.
