I'm a senior consultant with a Multinational and my GC was previously filed under EB2 . I received the PERM approval last month and as I'm currently in US on L1A , my friend suggests that I can file for EB1 under " multinational Manager" category as I have more than 12 months exp as a Manager outside of US in the last 3 year ( 2012 Jan - Aug 2013 ).
Before I reach out to my company HR , I need to know the process of converting my current EB2 to EB1. I did some reading on the internet and my assessment is below:
- EB1 filing will be new and the company needs to withdraw the existing petition before they can file a new one.
- EB2 PERM approval will in no way help / impact the EB1 filing as the petition will need to be withdrawn.
Please let me know if my read of the situation is correct.
Also , one other question I have is if the company HR says no to EB1 , Can I file it on a individual capacity as I'm on L1A and can produce proof of being a multinational Manager. Is it even possible ?
