  • pls help! travel required with pending i751

Hello! I really hope you can help me. Or help to advise how to enter this question to Forum

I have received I751 that will expire on January 20th, 2015, case is still pending and no official decision was made.

I entered a marriage in a good faith, but was subject to extreme cruelty and had to file for adjustment of status after 2 years by myself.
Now I have a stamp in passport and no actual green card with pending case, and it expires on January 20th as well
Because of my work I have to go to abroad and if I don’t go I will lose my job. So now I am very concerned, what will happen if my case get denied while I am away?
Flight dates are 22 December 2014 leaving USA, 27th of December coming back. Will I be let to enter USA if my case got denied while I am away on these dates?
Please help to answer! I will really appreciate a reply!
Immigration cant give me direct answer and I am not sure why

If you applied for "Removal of Conditions," to obtain your 10-year card, you would have received a one-year extension of your Conditional Status. If the one-year extension is about to expire, you can get an additional one-year extension from USCIS with an "INFOPASS" appointment at a USCIS office.

When you say below that you filed "Adjustment of Status," I think you mean "Removal of Conditions," a totally different procedure. Please clarify which procedure you applied for.

Hi Ray! Thank you so much for reply! You are correct, petition to remove conditional terms was filed and I received a letter stating that I got an extension for a year. But it says on the letter that if petition is denied, the authorization to work and travel denied too. So if I come back on 25th and my case is denied on 24th for example ( sorry I am being paranoid (), will I be able to enter USA? I have a stamp in passport and it is valid till Jan 20th, 2015

If you don't have an additional extension beyond 1/20, and you try to enter on 1/25, you won't be allowed entry (or even plane boarding abroad).

Get another extension (unless I am misunderstanding your information) and worry about a denial later (or just don't leave). You won't be denied without an interview.

Do I need to get a new stamp in the passport? Or how can I request a new extension? My return flight is on December 25th, before the expiration date on the I751 letter and stamp ( exp Jan 20th,2015)

You need a new I-551 annotation in your passport reflecting the extension. Without it, you might not be allowed to board a plane when returning to the U.S., or you might be barred from entry at the Port of Entry.

I am afraid I can't get stamp so fast, the earliest appointment with my local Uscis office is after my arrival, i will keep checking if there is any opening in case if someone cancel there info pass.
