  • Re-entry to US after 10 months

    My family got their GC by June 2014. They went to India by July 2014, with the intent to return before 6 months. So I didn't apply re-permit for them. Due to personal reasons, their stay will get extended for 10 months and they are planning to return to US, after 10 months outside of US. My wife does not have a valid US drivers license nor a US 'savings bank account. W2 will be filled in both of our names. Apart from it, there is no document to prove the intention of continuing to stay permanently in US.

    Will there be an issue when they re-enter in US after 10 months? Any documentation proof need to be provided for the longer stay in India. Is there any preferred Port of Entry for such situations to avoid hassles? Your responses is highly appreciated. Thanks!

    Green Card holders can reenter the U.S. up to a year from departure without any problem, unless they already have a history of length time spent outside the U.S., which may result in a scolding, warning or recommendation to get a "Reentry Permit" next time, to demonstrate "intent to return."
