  • Re-entry permit question

    Hi,

    I have a I-551 stamp on enterting US, but my wife is still in India , if she cannot come before 6 months from the date of issue of the IV , Can I apply for the Re-entry permit on her behalf.

    If not, Could you pls give me a suggestion.

    This is actually not a re-entry permit question.
    Since your wife has not entered the US yet, she does *not* have the GC yet.
    She *absolutely* has to come to the US within 6 months, otherwise, she will loose the IV, and with it the GC!
    You can only get a re-entry permit if you have a GC, and you have to be in the US to apply for a re-entry permit.

      If I quit my present employer before she enters US( before 6 months),
      Will this have any impact on her GC.

        JoeF,

        Can you explain this a little more to me. If a person is in US, and if he/she has a GC, then why need to apply a re-entry permit? The person can use his GC to enter US, right?

          Re-Entry permit etc.

          If you stay out of the US for over 1 year, your GC is considered abandoned, unless you obtain a re-entry permit *before* you leave the US.
          With the re-entry permit, the limit is raised to 2 years.
          For stays outside the US for less than a year, you do not need a re-entry permit. Depending on the circumstances, it may be a good idea to have one, anyway, to show that you did not intend to abandon your GC. If you stay outside the US between 180 days and 1 year, the officer at the POE may look at your ties to the US, and the re-entry permit shows that you did not abandon your residence in the US.

          As for the other question, your wife's GC is not tied to the employer. So even if you change the employer, your wife can get her GC just fine, as long as she enters within 6 months of the issuance of the Immigrant Visa.

            But as far as I know the INS at port of entry only record the date a peson enters US every time, by swepping the green card and stamping a person's passport. Everytime a person leaves US, there is no inspection at all, the person just board a airplane and go. So how can INS at the port of entry know how long the person has been staying outside of US, since the INS doesn't know when the person left US?

              does airline record your departure date?

              The airline asked me for the green card and I showed the lady the stamp. I guess INS knows this info from airline.

                Well, for one, the officer could ask to see the ticket stubs.
                Also, if they directly ask you, and you lie, you set yourself up for trouble. It could come back to haunt you, even decades later.
                Finally, you have to file tax returns, where you would need to record your income from foreign sources. If you don't file a tax return, or file a non-resident tax return, that's a dead giveaway.

                  Re-entry permit second time

                  Hi Joe
                  I have one question see i have to come back to india after getting my GC
                  I filed my re-entry permit .I got it its valid upto jun-2006
                  Now due to certain constraints i can not go back to US i came to know
                  i can file re-entry permit one more time .
                  So that i can keep my Status Valid with GC
                  But i came to know when i will be filling this re-entry permit i have to be in US
                  and i have to surrender the old one for getting new one.
                  I have to file re-entry permit one more time but when i will do it i will file the form i-131 and come back
                  While coming back i will not have any doc in my hand
                  Some body told me it may create problem
                  I will appreciate if you can throw lights on this

                  Also heard that once our GC becomes invalid we have to reutrn back it but we get 10 years b1 visa

                        I'm hoding the GC right now, I always travel outside US without re-entry permit.
                        But I heard that in 2007. I do need a re-entry permit if I travel outside US. Is that true????

                          i just want to ask if we need to let our re-entry permit signed here in our country's consulate or us embassy, because my wife had been staying for 1 yr. and1 month and it will expire after 2 yrs..... thank you..

                            As far as i know, reentry permits can only b eapplied for inside the US>.......if i'm wrong, would someon eplease giv ethe correct information
