Can I go back as a dependent on my child's citizenship?

  • Can I go back as a dependent on my child's citizenship?

    Here is my story -

    child ( minor) - US Citizen
    Myself ( mom) - GC

    Due to certain circumstances I have to stay back in India. It's been a couple of years since me and my husband got GC ( husband primary). We might end up in a divorce shortly.

    For the last 5 months I have been staying in India with my child and will have to continue until I do not know when. So, my question is -

    Will I loose my GC if I do not go back within 6 months or a year?
    If I loose my GC and status, Can I go back in the future ( may be a year or two later) based in my child citizenship?

    Please suggest. I do not want to loose my GC after getting it waiting for so long.

    If you lose your Green Card status, your child can petition you for an immigrant visa if he is age 21 or older.

      Oh, she is just one. So, I will need more suggestions here.

        You should consider continuing to meet the requirements for maintaining your Green Card status. If you leave the US. for an extended period of time, apply for a Reentry Permit before you leave.
