I have a conditional green card that expires in Sept 2014. I need to apply for I-751 waiver because I'm getting divorced this June. My question is that I need to travel in June / July 2014. I have enough evidences to apply with but I don't have the final divorce decree yet which will come through by end of June.
Can I apply for I751 waiver right now without final divorce decree - does that automatically extend my conditional GC for 1 year and then submit the decree when it comes through and USCIS issues an RFE for it? or is it better to wait for the final decree and then apply? I want the process to begin and if filing earlier helps, I would like to do that.
