    My story is a little complex and with lots of details that extend to about 27 years of historical data. please view all the details as there are several different problems that i face due to my many illegal entries into The USA.

    It all started when I was about 15 years old. I ended up living on the street of Mexico. My father married a young wife and mi mom had four other kids to take care of. My grandmother took me in but they couldn't afford any longer to take care of me. They sent me back to my mother and my mother told me to fend for myself. So, after living on my own, going hungry, several suicide attempts, sexual abuse, homelessness I meet a lady who told me that life would be much easier in the USA. Knowing that I had a cousin in Chicago, I decided to come to the US.
    After I arrive in Tijuana I learned that the only way for me to come to the USA was by jumping the fence. So a smuggler brought me into San Diego.
    This is where my problems with DHS started:

    1 I came across the US/Mexico Border through Tijuana in 1989
    2 I lived in San Diego was able to work and take car of myself
    3 Life for me was much better, I didn't wanted to get deported, and wanted to find a way to legalize my situation
    4 Not knowing the language I hung with other Mexicans. One of them told me that if I get caught to claim Political Asylum, then I would be given a work permit
    5 Not knowing what to do, I continued with my situation. One day while I was going to take the train to Chicago, the INS took me in
    6 So thrusting what the man told me, I told INS the I wanted to file for political asylum from Brazil. (So they wouldn't take me back to Mexico)
    7 Then after a couple months I had a few court hearings for my case, then released on a Greyhound bus to live with my cousin in Chicago
    8 Since I had no evidence to prove anything of what I was saying was true, my case was denied, and in 1993 I was ordered to voluntarily deport myself

    10 Two years before i got deported, my cousin showed little interest in continuing to help and I ended up homeless
    11 While at a homeless shelter I meet my wife, a US citizen
    12 Me an my new wife had a daughter and she told me that she would petition for me
    13 Then in 1993 under my political asylum case, I had order of deportation and got deported, and was very sad to leave my family

    15 After a few weeks of living in Mexico, couldn’t stand being without my family, so I came back
    16 I came back, reunited with family, got a job, and In 1994 my second child was born

    18 Due to not having the funds, the petition process didn't resume until 2002 when my wife (now ex-wife) petition me via a hardship waiver
    19 My lawyer then, told me that I was ready to visa interviewed, all I had to do was go back to Mexico to Juarez consulate for my VISA
    20 After the first interview, the Juarez consulate didn't believe my that I was from Mexico, and didn't give me the Visa. Instead the had me come-in other several other interviews
    21 They kept saying, "tell us the truth! Your are really from Brazil right?. Perhaps one of your parents is from Brazil right?"
    22 So at each interview, they would request a new piece of prof such as my mother's birth certificate, my Mexico school records, etc., I gave them all they ask for
    23 Since I had to work and be there for family, each time I had to interview I would come across the US-Mexico border without inspection
    24 Finally the consulate officer asked me if I was coming into the US illegally, I replied yes.
    25 On last interview, my ex-wife, me, and the Consulate officer got into an argument. I was told that I told them that I was claiming US citizenship each entry into the US
    26 Therefore I was denied for a hardship waiver
    27 In total I have about 3 or 4 interviews at the Juarez consulate

    29 Not knowing the trouble I was in, other attorneys told me that I was permanently barred from the US.
    30 Sadly, not having the money to continue to fight my case, I continued living illegally in the US

    32 As the years passed by I continued working and went to college part time
    33 It wasn't until 2010 when I learned that I had triggered something call 10 year ban which my previous lawyer never warned me about

    No I'm desperate because I can't work, my kids are now 22, and 25 years old, and am no longer married

    I sought help from several lawyers and they told me as follows:
    A waiver can be used for false political asylum claim - Since applications didn't show warning of false applying for political asylum in 1989 application
    The false claim to US citizenship can also be argued since they have they have no proof of my saying that. I was just denied due to false US citizen claim
    I have triggered a 10 year ban - Due to my current circumstances I don't have a good reason for a waiver in this case

    False political asylum

    No longer married to a US citizen
    My daughters are no longer minors (no hardship can be proved)

    Pros
    no criminal record of any type
    no DUIs
    I went and paid my way through college
    my daughter is in the NAVY
    I'm an outstanding (illegal) citizen
    pay taxes



    Questions:
    1 What is the biggest obstacle in my case?
    2 Can a 10 year ban waiver be used in my case? I no longer have dependents
    3 Is anyone familiar with a case like mine. Can recommend a lawyer?
    4 What else can I do?
