  • Conditional Residence And Extension Letter Expiring Soon

    Hi,
I am a Canadian citizen with a green card through marriage . I was granted the conditional permanent resident on 5/8/2015. I filed my I-751 (and paid my fees) within 90 days of the second anniversary of this date to get the conditions removed. I did receive a one year extension which expires on 5/8/2018, That date is approaching and I (like many others on this forum) have yet to hear anything back on this. My wife and I would like to travel to Canada in June and Ireland in August so I am wondering if I need to do anything before hand? If I don't hear anything back from Homeland Security before my status expires on 5/8/2018 do I need to do anything? Will I have issues getting back into the country with my expired resident card and my one year extension letter that will also be expired at that point?

I did read about getting an I-551 stamp? Is that something I should be looking into?

    Thanks.

Your status doesn't expire on 5/8/2018. You remain a conditional permanent resident for as long as the I-751 is pending, no matter how long it takes. However, you will have no proof of that status after 5/8/2018, so you will not be able to board a plane back to the US in June and August, if you haven't gotten the new card by then. You should make an InfoPass appointment at your local USCIS office to get an I-551 stamp on your passport as temporary proof of permanent residency. Many offices have all appointments taken, so check early and often.

This is my personal opinion and is not to be construed as legal advice.

Thanks for the advice! My local office actually has many open appointments so I will be booking something soon to get the I-551 stamp.

You are actually eligible for citizenship and if you are considering becoming a citizen, you should not delay filing your N-400 because your I-751 has not been adjudicated. Conditional permanent residents are eligible to apply for citizenship. This is straight of the USCIS policy manual. Furthermore, your N-400 will likely be processed before you even hear anything on your I-751. This will cause the adjudicator to have to go grab your I-751 and either finalize it or put it at the top of the pile of whoever has it. Here is the timeline of someone from another site - vis@j0urn3y. Look at the dates and you'll see USCIS sat on this I-751 from 5/5/15 until its approval on 3/28/16.
Coincidentally, The person filed for citizenship on 03/22/16. NOA on 3/25/16. There are many cases like this one. You would be filing for citizenship based on marriage to a US citizen and your spouse would have to be present, and you will have to have some proof of bona fide marriage - nothing as hefty as the proof for the I-751- but clearly the marriage is real at the 3 year mark when you are applying for naturalization. So if there is a N-400 based on marriage to a US citizen, they just push that I-751 through because they will have the two of you there for an interview anyway.
Sure, you can make an infopass appointment and get a I-551 stamp. since Canada is down with dual citizenship, I Just wanted to make sure you knew this is also an option.

Yes. You better get i-551 stamped before you leave. Get an appointment ASAP because it is very hard to get an infopass appointment. It gets booked within seconds and you have no slots open for 2 weeks. I got mine after a month and I checked 15 times daily if any slots were open within 100 miles of where I live.

Next time you need one, you can use two google extensions - Visual Ping & Super Auto Refresh. Google this as is, including quotation marks, "How to get an appointment on infopass". It will be the first result. It's a thread from another site. Explains how to use those two extensions. Very easy.
