  • Invalid Green Card

    I got my LPR status in May 2010 under F4 ( Family of US citizen) category sponsored by my sister. I immigrated to US along with my family ( Wife & two sons) . Thereafter my sons choosan to stay in US and continue their studies in US universities, I along with my wife returned to India but keep on visiting US regularly to protect our LPR status till May 2015.

    In 2016 my sons renounced Indian citizenship and become US citizens. I and my wife last returned from US in June 2015. After June 2015 we never returned to USA to protect our LPR status, so our Green Card become invalid in June 2016 but till date I have not surrendered it to the US embassy.
    Initially we were sponsored by my sister. I do not want to apply for returning Visa as its approval appears tough in my case. Now my query is:

    i. Can my son who is now a US citizen can again sponsor me for immigration to US.
    ii. Do I need to surrender the invalid Green Card before I file my fresh application of immigration Visa or the same can be returned at the time of interview for immigration Visa.
    iii. Do I need to surrender my Green Card even before my son file sponsorship papers (I-130) a fresh in US.

    i. yes, assuming your son is 21 or over
    ii. no
