  • Green Card for my Parents

    Hi All,

I applied for Family Based Greencard for my parents in 2014 and they came to US on April 2015 and they received their Greencard roughly about 2-3 weeks later. Their GC shows Residence since April 18 2015. My question is this, They have been traveling outside US multiple times now in the span of 3 years and sometimes staying longer than 6 months. After speaking with an immigration lawyer/s they have advised me that they shouldn't stay outside US for longer period of 6 months, their GC may be taken away from them.

Anyone has any experience with this type or any insight as to if this is true?

    Thank you in Advance

If someone applies for a visitor visa, they can stay up to 6 months, and they can obtain a 10 year multiple entry B2 visa and come every year. So if your parents are not staying here longer than 6 months at anytime, why did you apply for their green cards? Green cards are meant to be for people to reside in the U.S.

A green card holder must live in the U.S. at least 6 months a year, or not be outside the U.S. for more than 6 months during a year. Otherwise, it can cause loss of the green card. The way it's looked at is, if their not going to use it for what it's for, they probably don't need it.

This is my opinion and not legal advice. Use of this information is strictly at your own risk.
