misspelled last name on green card

hello every one
i got my GC couple weeks ago and notice that last name was misspelled i did some riding and asked my lawyer(that im not really trust) and been told that i have to file a i90 application that is not the problem my question is hows fault it is.on i485 application the last name was wrong but the lawyer says its usics fault because we sent them copy of passport and birth certificate and marriage licence so they should notice that tha name spelled wrong but like i said i dont trust this lawyer hi did some mistake along the way and i want to make sure before im filing i90 hows fault is this just not to spend time and pay the fee if i have to
also i am planning to travel out of the country so how or what i need to do i have tickets to jun13

If you misspelled your name on the I-485, then they will call it your own fault, regardless of whether they should have spotted the mistake with your passport or birth certificate. I would imagine they will make you pay the fee associated with the I-90, but someone else may be better equipped to tell you for sure.

You should definitely try and get it rectified before your vacation outside of the country, as if the CBP officer spots the inconsistency in the spelling, you may have trouble getting past them. Although it's likely that process will take longer than the 4 weeks you have available.
