  • travel less than 6 months

    mentioned in this very website:

    'less than 6 months
you are allowed to travel freely outside the u.s & return to the u.s.
traveling outside the u.s for less than 6 months in a year (continuous or frequent trips) is not a problem.'

so as a gc holder, if i 'visit' u.s. from my native country once every 5 months, would my pr status be not in jeopardy.
would that 'not' be tantamount to abandonment.

It's not that simple. The physical presence is a big factor, but not the be all and end all. If you're obviously not making the US your home, i.e. your permanent address isn't here, you don't have a bank account with checks from a job in the US, insurance, vehicle etc, they can consider that to be abandonment. Not having one of those things won't cause you to be considered abandoned, but it's quite obvious to the officer when they look at you in the grand scheme of things, including the number of frequent trips abroad (no matter how long) that you're not making the US your home.

They're not stupid, you can't just circumvent the laws by visiting the US one every 5 months and thinking that will be okay. If you don't intend to make the US your home why did you bother to become a permanent resident in the first place?

For starters, stop saying that you will "visit" the US from your native country. Here is a good document for you. Read it and digest it. It explains abandonment nicely.

Why don't you file for a re-entry permit?
