  • Maintaining Green card when severely sick

    Hey Guys,

    How is everybody doing?

I feel severely sick few months after getting my GC in 2014. I developed a brain issue (I almost died) which required long recovery which means many years so I moved temporarily to india to cut cost of my health recovery and medical and maintenance. This is my 4th year and re-entry permit has been renewed second time and it expires on 27th feb, 2019.

I may need more time for recovery. At best 1 year and worst 2 more years. I am not working during this time. I have two options:

    1. Renew my re-entry permit again max two times
    2. Visit USA every 6 six months for next two year

Cost of both options is almost same (second one is slightly cheaper).

but which option is less risky? If there is no risk of losing GC on second option, I would like to go for that but I have heard CBP does not like people who return just few days before 6th month to "touch US Soil". what do you guys recommend?

also, if there any financial support I can expect by any means if I return to US and do not work until I recover (max 2 years) and will it affect my GC? My quality of life is not deteriorated due to severe illness because I am in india and I have saving which can last many more years. These savings will evaporate quickly in US as cost is high and things get tough when not working.

Thanks for helping out guys. It means a lot to me.

    Sal

if you have a re entry permit, I'd recommend option two. honestly it's going to look bad either way. but if you explain the situation, they might give you some leeway. best of luck
This is strictly an opinion and should not be misconstrued as legal advice. The use of this information is strictly at your own risk.

so, you are suggesting not to renew re-entry permit again?

No I'm suggesting use the re-entry permit to re enter this time. at which point when you decide to go back to India, you explain to them what's going on, and ask for their recommendation or contact USCIS beforehand to seek advice. but coming and going every six months is actually a unfortunately common occurrence. some permanent residence have a green card and live 6 months in India, 5 month 3 weeks in the US in order to keep the presence qualifications met while still technically living in India.. you're choice but again either way is going to be sketchy to them.
