  • Can we have international travel right after we received the green card?

    Dear All,

I just received my EB2 based green card (like two days ago), and I would like to do an international travel back home next week. Would that be ok? Could I still come back to the States? Is there any additional documents I should prepare in order to re-enter to the States?

I didn't have H-1B visa stamp (but I did get selected for H-1B this year. Should I apply for the H-1B visa while back home even if I have the green card in hand? ) and I was in F-1 status before.

    Thank you,

    CY

how long would the trip outside be? if less than 6 months, you should be fine. no issue at all, but for longer, especially more than 1 year, you are better of with having a re-entry permit.

less than 1 year but more than 6 months, will be frown upon, but still not an issue, though more than 1 year, the GC would cease to be a valid entry document to the USA (and you might be called to appear before an immigration judge)
