  • Divorce and Conditional Green Card

    I know this has been answered before, but I have an additional question. I came here to the US from the UK in April 2000. My employer at that time was sponsoring me for a green card, but unfortunately they laid me off just days before I was due to get it.

    At the same time I was married to a US citizen and so she agreed to take over as my sponsor and we petitioned for a green card through marriage. We had been married for less than 2 years when the green card was approved and so it is conditional. The marriage is bona fide and we have several people, both personal and professional who can attest to that.

    Sadly, due to problems within our marriage, my wife has asked me for a divorce. I am not due to file for removal of conditions until at least November of 2007. I understand that I can apply for a waiver to avoid being deported, and which will allow me to have the conditions removed without her. I am wondering what the likely success is with these waivers. Is it common to have them denied ? Naturally after nearly 7 years here I have accrued a sizeable amount of debt that I will have great difficulty paying off should I need to leave the country, especially with no income.

    the waivers are routinely granted. it will depend on your evidence as to the legitimacy of the marraige, and not just attestation from people. Let her file for divorce....but if you cant apply until a year from now, it seems like you just got your GC..try and delay the filing of the divorce as long as you can

      Thanks for the response. We will be married two years in Jan 07, but I agree, try to hold off filing for divorce as long as possible.
