  • Marriage to a GC holder

    My fiancee is getting his green card in six months. I wanted to know if:
    Should I marry him now and apply for a GC or wait till he gets a GC and then a marry him and apply? Which is quicker to get my GC? Should I marry in India or the US?

    What is he receiving his GC under?

    Is it family or employment based?

    If it is family, you can no marry him or his petition will be void or delayed.

    If it is employment you should marry him before he gets the GC and then file I-824 (follow to join) for you to get one.

    If it is employment or family and marry him after he gets his GC, you will not be eligible to get a GC for 5-6 years.

      Thank you for the response.

      It is an employment based greencard. If I file the I-824, how long will it take before I get my GC?

      Also, should I marry in the US or India or it does not matter?

        It does not matter where you marry him, but you must marry him before he gets his GC approved. And, it would probably take around 6-10 months.
