  • Change name while applying to remove conditions on residence

When I got my conditional gc via petition of my husband two years ago, I used my single name. My gc is expiring on 06/28/2008 and I’d like to start using my married name. I’d like to have my next gc to reflect my married name and then change my passport, driver's license, ssn, and other accounts while the I-751 is in process.

    1) Will it be a problem if I put my married name in the I-751 (Petition to Remove Conditions on Residence) form?

    2) Will they deny the application because the Last and Middle names in the I-751 are different from the original gc?

    3) Will it be a problem if all the supporting documents I send together with the I-751 are still under my single name?

    4) Should I just send my marriage license to prove the name change?

Please advise. what should I do?

    Thanks,
    Pat

Hello. I have the same issue. I filed for Green Card originally with my maiden name. During my Green Card interview back in 2018, I asked the officer when I could change my name, and he said only with filing documents for naturalization. I even asked the Officer if I could change it with documents when will be removing conditions, but the answer was negative.
So I am also about to file documents to remove conditions on the green card and I am using my maiden name. Hope this helps. Good luck.

No, but you must include a letter clearly stating that you want to have your new name in the 10yr year greencard. Include the marriage certificate & any related affidavits.

      2) Will they deny the application because the Last and Middle names in the I-751 are different from the original gc?
      NO. You must include proof

      3) Will it be a problem if all the supporting documents I send together with the I-751 are still under my single name?
NO. USCIS understands that you just can't adopt a new name (for bank accounts etc. )if your passport and current GC are in the old name.

      4) Should I just send my marriage license to prove the name change?
This is Mandatory along with an affidavit of what you want
Opinion only. Cannot be construed as legal advice.
