My wife and I have successfully navigate the paperwork and procedures and she is now a naturalized US citizen. Next on our efforts is the removal of conditions for her son (soon to be a nursing school graduate) via form I-751.
He will be filing under the option:
'I am a child who entered as a conditional permanent resident and I am unable to be included in a joint petition to remove the conditional basis of are alien's permanent residence (Form 1-751) filed by my parent(s).'
The instructions for the I-751 only state: "If you are a child filing separately from your parent, also submit your petition with a full explanation as to why you are filing separately, along with copies of any supporting documentation."
This seems to be very vague compared to the other parts of the instructions where they are very detailed about what they are looking for.
Has anyone experience filing this form for a child such as indicated above? The approval process was initially slow when we got married - we made the decision to allow him to complete his schooling rather than interrupt it and delay his graduation. Do we simply write the USCIS a letter indicating the family decision for our child to complete his education and provide evidence of his relationship to us, tax returns as well as school documents, degree, etc.?
Any examples or experience with filing the 751 for a child filing separate from his mother? He's already got his conditional permanent resident card, but later this year, he will have to file to remove the conditions.
