Dear Friends,Here is my story. I hope that someone can help me out. I came to the US on a H1b visa with a valid job offer and the visa was valid till oct, 2010. before coming to US i got married to a US citizen girl (indian) and i came with her to the US. ours was a traditional and genuine indian marriage arranged by the elders of our family. now when i came here i did not join my employer and neither did i contact them coz my in laws and wife did not let me join there. they said get a green card and get a job somewhere else coz we dont want you to go away from us. they wanted to keep me as a home based son in law. i applied for green card through adjustment of status (I-485, I-130) and i got a conditional green card thru her which is valid for 2 years. the problem is i developed some differences with my wife and in laws and both of us are not living together as of now. i was staying with them. the issue is i used to do some casual chatting with girls on the internet which they found out and make it a ground saying that i was cheating with my wife. i left the chatting habit once i realized that it was not good. they have all the printouts of the chat logs and emails exchnaged.i never cheated on her and neither was my intention to leave her once i get permanent green card. i did not have any physical contacts with women and i desperately wanted to get her back in my life. On one of the immigration forums on the internet i asked them whether i can apply for permanent green card if in case we get separated due to personal issues. The reason being my in laws were abusing me because i only had conditional green card. they stripped me off financially, they used to take all the money i was earning and ill treated me. And i was afraid that they will separate me from my wife and finsih my green card status. Fed up of this ill treatment i asked that question on the forum. i came to know that many spouse who have sponsored their marriage partner take advantage of this situation and blackmail the person holding the conditional status. in this case the victim is a male and not a female. she found out about this question i asked and is making this as a reason that i wanted to divorce her once i get permanent green card. she says that she wont help me in applying to remove the conditions on the green card and she has also taken away my green card. they have it and they are not giving it back to me. she is finishing off each and every evidence of our marriage like clsing our joint bank account, she stole the marriage certificates from me as well. i can arrange for a duplicate marriage certificate.
as of now my H1 is also not valid due to the fact that i was admited as an immigrant. after 2 years or now, i will have to apply alone to remove the conditions if the divorce case goes into court. my wife wants a divorce from me and she says that she will make sure that i get deported. i dont want o go back. i have done a lot of hard work to come to US to realize my american dream.i dont know whether i will get the permanent green card or not. meanwhile i am working in a IT company for the past 1 month based on my green card. i want to know whether i can get my H1 b visa reinstated if i dont get permanent green card. if i can do that can i do that with a different company? is it enough if i get my h1b petiton approved through another sponsor? i already have the stamping. my only question is if i can get the I-129 from another company, will i be in a legal status if i lose my case while applying alone for the permanent green card. we are not divorced as of now. do i need to divorce her(which i dont want to) to get my permanent green card. I'm making one last ditch effort thru our elders for the reconciliation with my wife. if it doesnt work then i have to go legal to save my status here. should i hire an attorney? Please help.
