  • Returning to US after a year

    Hi,

I am returning to the US after a year. I don't have a re-entry permit, I was under the impression I had it thanks to someone lying to me.

Anyway, I am told that I need to apply for a returning resident visa, but I am confused as to the proof I have to give. How do I file for taxes from India? Is it a better option to surrender the green card and go for a non-immigrant visa like B-1?

Please let me know, I don't have residence there as we always lived in rentals.

    Regards,
    Shweta

You mean you did not file the taxes that you are required to do as a PR even if you are outside the US.

That supports the theory that you abandoned your residency.

      Filing Taxes

      Hello,

I wish to file taxes now, I have already sought an extension for the same. I just am confused about the procedure. I do not wish to abandon the Greencard.

I have tried the online tax filing, but it says that you cannot e-file the same.

Is there any other way to do this? I also have a bank account there, will that help?

My sister lives there, she is in Green card processing, my sister-in-law lives there, she is citizen and my kids are both US citizens.

      Will that help?

I need to know what is better, apply for an SB-1 visa or surrender the GC and apply for a B-1/B-2 visa?

Also, in case I surrender, how can this impact the future, if my children sponsor me for citizenship when they turn 21?

Please help and let me know.

      Regards,
      Shweta
