Filing I-751 while citizen spouse imprisoned
I will be filing my I-751 in a few weeks to remove the condition from my green card. However, my husband is currently in prison and will be there until 2010. We were married only a few months before he broke the law and was imprisoned. So, how will that affect my application? We haven't even been able to merge financial stuff or anything much else. Can I divorce him based on his imprisonment and then file as a divorcee?
