    I really need your advice. Greatly appreciate in advance.

    I got my green card by married. I'm divorced last year. My 2-year green card will be expired next month. I'm filing I-751 at the end of July by waiver (myself), but didn't receive any receipt yet.

    I gonna travel oversea at December 2008. If I dont get anything such as receipt from INS on December, can I travel oversea and re enter by re-entry permit, my expired green card and passport?

    Should I apply for re-entry permit now or I better wait for the receipt from I 751?

    Does anyone know how long does it take for extension letter from I 751?

    If I file re-entry permit now, can I get it before December? I heard that I dont need to take the biometric for re-entry permit, but why do they require biometric on the USCIS website?

    Anyone knows please help me?

    Once your 2 year conditional GC is expired, you can not use ANYTHING to re-enter except for that GC ALONG WITH THE EXTENSION letter for the i-751...

    A re-entry permit will not help you here... sorry.

      Thank you for your reply. I dont know why my lawyer said I can re-enter with re-entry and expired green card. He said re-entry as strong as green card. And I have a friend. She came here by her fiance. She went oversea before she got the green card and came back by her re-entry and no green card. Is it good for me if I just re-enter by re-entry like her?

        I said NO. You can not.

        Your friend probably entered using an Advance Parole through deferred inspection.... so this is not your case.

        Re-entry permit is only valid with a valid GC and you have to wait for the Biometrics for it anyways.

        Do not fret, you should have you I-751 receipt by December.
