After reading this complete thread, what do u think are indianinus chances to get permanent residency once the divorce is finalized with his wife. your inputs are greatly appreciated. i am not talking about the student visa issue. i dont know why he put his inquiry in my inquiry.

That might be ture to wait until the time comes, because you can not really do anything before the time comes. But it is conditioned. Not all of the cases should wait. I kinda think this attorney's suggestion is skeptical. No meaning to offend anybody, but I think your attorney's reply is very sketchy.
In your case, I personally think that you should do it on your own, meaning that you have to divorce before you can apply for the GC. If you want to file a joint application, if the officer decideds to give you interview, if your wife gives you a revenge in the interview, you will be toasted. Not to mention your GC. If you divorce her and file the petition on your own, you do not have to wait until the time comes. You can file the petition as soon as you 2 divorced. But make sure you have all of the following required evidences before divorce. Those evidences are very important to you to get the GC, so you should work hard on getting thoses evidences.
all of your identities,
your marriage certificates,
your photos with her especially the wedding photos,
shared properties evidence,
you 2 travelling tickets,
living together evidence,
finally, you should draft a very clear structured, faithful and honest self testifying document.
But, i am not a lawyer. You might want to talk to more than 1 attorneys. My suggestions all came from my experience and the knowledge delivered from my attorney when i was applying for my GC.Last edited by touchsky88; 02-03-2009, 02:48 AM.

what to do
am in a similar case my condition is about to expire and am still married but with the way we seperated i dont think she will sign it but we have two kid together and i would like to know what to do to get the condition remove

I got divorced sometime back. it was an ordeal but nevertheless i feel relaxed now. it was an ordeal because a false domestic violence case was slapped by her on me(obviously to jeopardize my immigration case). thankfully she lost it and i was not found guilty. i am also talking to some good lawyers regarding my immigration case.
the last member who replied on this post. try to get the divorce and then try to remove the conditions on your own. not getting divorced and applying jointly will be a big problem for you. talk to a good lawyer.
this is just an advice.
