  • GC and travel question

Hi, I have read in the FAQ that with a GC you can travel outside the US for less than 6 months in a year without a problem.
    1) Is year considered to be from Jan to Dec or is it any 12 month period?
    2) If you make many trips, should the total be less than 6 months in a year or is it that any single trip should not be more than 6 months duration?
    Thanks

You've got it all wrong ...

... there is no problem for travelling as many times as you want to and for a longer time period, as long as you do not work outside the country and your primary residence remains as United States.

You cannot remain outside the country for more than a year without a re-entry permit.

In case you want to file for a United States citizenship later, then your continual stay requirements are calculated, which in term effect the more than six months stay outside the country, otherwise this does not impact you.

The year, is a full year not a fiscal term between Jan & Dec.

Remember you've got a residency in this country, do not misuse it or do not try to find loopholes or try to fool the system. Your primary residence and primary place of work is and should remain as United States of America.

    Take care.

I think I may not have put the question correctly. To give a specific example, if in a given year (2007), 2 trips were made as follows:

      FIRST TRIP - duration of 4 months [between Jan 1st, 2007 - May 1st, 2007]

      SECOND TRIP - duration of 4 months [between Aug 20th, 2007 - Dec 20th, 2007]

so each individual trip was for only 4 months (hence less than 6 months outside at a time) but the total duration outside in the year 2007 was 4+4 = 8 months (which is more than 6 months totally in the year 2007). Does this break the continuous residence requirement?

[The FAQ page says "Travelling outside the US for less than 6 months in a year (continuous or frequent trips) is not a problem". Also, I am aware of the Physical Presence requirement.]

I would greatly appreciate any response.
      Thanks

        Not a fiscal year ...

... I answered the same question elsewhere, just now.

        You're good.
