If you are filing jointly (with your spouse) you have to file within 90 days before expiration... if you divorced, or your spouse died, then you MUST file as soon as possible, before the GC expires.

i dont know if i read it right on the filing instructions for I751 but if you are divorce you can file before the 90 days to remove the conditions as you are applying for a waiver, am i interpreting it right.
