  • GC Holder outside of US for 2 years

    I am sure this question may have been addressed elsewhere.

    I moved out of US in Jan 2007, me & my wife are GC holders& my kids are US citizens. Before leaving US we did apply for Re-entry permit & received it in April 2007, which is valid till April 2009.

    I still own a house in US & have filed my US taxes for 2007 & will do so for 2008 also.

    I intend to visit US in April 2009, before Re entry permit lapses, however I may not be able to re apply for re entry permit again as I am traveling for only two weeks & biometric requirements will not be complete in that much time frame.

    What will be my options to retain my GC in future, does owning a house & filing US taxes & making annual visits support non-abandonment of residency status?

    Thanks in advance for your views.

    Return to United States of America ..

    ... and live here permanently. You have a house here, live in that house. Buy a new property, prices are very low now, good investment.

    If you do not plan to live here, then you may as well kiss the country good bye forever.

    Unless you have an income in the United States, I assume you mean that you file tax returns, not necessarily pay taxes.

      Working outside the US for a non-US company is often considered proof of abandoning your GC. If this is how you have been funding your lifestyle, you may already be in trouble.

        I filed taxes on my global income & paid taxes in US also over & above what I paid in India

        I am working for a subsidiary of a US company in India.

        I moved back to India to deal with some personal issues & for taht very reason I did not sell my US property. Mya plan is to return back to US in a couple of years.

          If you're ...

          ... planning to return to United States shortly, you may very well consider living here for now for some time.

          Then establish a business relationship in India for which you may be able to travel for lengthy periods of time.

          You seem to be a honest and sincere person which is unfortunately a rare trait these days.

          I'd strongly advice you to consult an attorney and a CPA in United States and make a plan on how you will manage to retain your residency and yet be able to be in India for a longer period of time.

          Remember, you need to "live" in US and just "stay" in India for lengthy periods of time, not the other way around.

            Since you have an employment relationship with the US, have the company's US attorneys advise you of how best to handle the problem. They should know if your situation can be used to demonstrate that you have not abandoned your LPR status.

            Unfortunately, it may be necessary to choose between your presonal relationships/issues in India and your US residency.
