My domestic partner, USA citizen and soon to be spouse was offered a 4 year job in Australia that we took. I presume I could apply for a spouse greencard at some point in the future but do not want the hassle.
I still work for a US company and may be returning to the USA early next year.
I wanted to apply for a re-entry visa just before we left about 6 months ago but found out at the last minute about the need for biometric tests.
I own a house in the USA that I rent and still actually work for the same company I’ve worked for in the USA for 10 years, but now work remotely. So I pay US taxes and will continue to file and pay taxes (they are changing my status to a contractor soon and I will pay my income tax/social security to the Australian government and work through an Australian agency)
I will be returning to the USA for about a month early next year as part of a business trip for the company I work for.
I want to apply for my re-entry visa but am a bit unsure as to how the process works. I understand I can submit the I-131 electronically and leave the USA before the application has been processed; this is what I wanted to do originally.
I now understand that I need biometrics, if I come back to the USA for one month and submit my I-131 immediately would I get my biometrics appointment in time? Does anyone know how long it takes from submitting the I-131 to get a biometrics appointment?
If we stay here for the full 4 years I will also have to renew the I-131 – does anyone know if this should be done before of after the expiration of the original and if you need to be in the country to renew?
I’d also be interested to hear if people thought I had other options available?
If you managed to read through all this and have any information that could help I’d appreciate it.
