  • Re-Entry Permit

    Good Day!

I would like to ask someone about this matter. My parents were given a multiple visa good for 10 years way back in Philippines and as of now, they are here in USA. We applied for an extension of their stay and it will expired on May 20, 2009. The question is since they got a multiple visa good for 10 years can they travel to Toronto, Canada before their I-94 expired and come back here in USA instead of going back to Philippines? We are planning to buy a ticket from Tulsa, Oklahoma where they are here right now with me and go to Buffalo, New York & my Aunt will pick them up at the border over the Buffalo New York and travel by land. Can they do that?

They have a valid passport, valid multiple visa for 10 years & I-94.

Please help me with this matter I will really appreciate this.

    Thanks!

You can't do that. They can't go to Canada and come back and get new I-94.

But according to the article found at Immihelp they can do the visa stamping. https://www.immihelp.com/usa-visas/visastampingcanadamexico/

So, are you saying that they really need to go back to Philippines? And also, they already given an extension of stay and it will expired on May 20, 2009 can they still apply one more time of the extension of stay?

Is there anything I can read this matter.

Visa stamping is not the same as I-94. Read https://www.immihelp.com/visa-stamp-vs-authorized-stay-duration-in-usa/

Im so sorry If I email again I am a bit confused. USCIS said as long they have a valid passport & valid visa they can enter USA from Canada or Mexico. I really need some help.

Thank you for your reply awhile ago.

They can enter but that does not mean they get I-94. That is because the current I-94 is not collected when you go to Canada.
