  • Marriage Fraud Accusation

    What a mess. I obtained my permanent resident card on May 22nd (temp conditions removed). On June 28th, my wife abandoned the marriage (I came home to an empty house). On July 15th I was served with a petition for divorce with the primary basis being marriage fraud for the intent of obtaining a green card. I really don't know what her basis is...she won't talk and my lawyer has requested the information. What happens in divorce court remains to be seen.

    What worries me the most is that she contacted USCIS on June 11th and made a subsequent phone call to ICE, presumably to report said fraud. It's now been over 3 months so I'm wondering on what basis USCIS decides to investigate, what the process looks like, etc. Am I safe after 3 months or is this something I'm going to have to worry about for an indefinite amount of time? I have lived in the U.S. for over 17 years now and consider this my home so I really don't want to leave but I suppose I need to condition myself for the possibility that I might have to return to my home country.

    Any information anyone can provide on marriage fraud investigations would be greatly appreciated!

    Hi Rene, I have a friend with a similar situation like yours.... my friend ( wife) she petitioned her husband who was an illegal alien for so long... he got his permanet green card.... until oneday they have some fights which even lead on calling a police in their house... the husband left the house, my friend was really devastated, and the following day my friend went to ICE and filed a complaint againt the husband, she said that the husband uses her to gain permanent residency here in the US, but the officer said that they cannot do anything about the husband since he already got his permanent green card and that they've been together for more than 3 years... my friend left ICE office really disappointed.. the husband is still here living like nothing happens...so I think you cannot apply for naturalization based on marriage... we're still waiting ( me & my friend) for any developments regarding this matter...

      Thanks for the reply. What you said confirms what I think to be the case...once the permanent green card has been obtained, revoking it is difficult. In my case, she was the one who left me and is using green card fraud as the basis for her divorce petition in an attempt to gain more than half of the community property. But I don't think she knows that I finally got the permanent green card. She amended her petition to include an anullment, which if granted and I still had temporary status, I'd be in a heap of trouble.

      The whole issue has me rattled though and I didn't realize she hated me that much. Divorce is one thing but having to worry about my immigration status is another.

      Nope, I don't think I'm the husband of your friend! I've been here legally since the day I entered the country. Does your friend have 14 cats?

        No, my friend's fraudulent husband does not have 14 cats, I doubt seriously if you do either, that sounds like an exaggeration to throw me off the suspicion. Now, I'm even more convince that you're the fraudulent husband of my friend. By the way how come you had 17 LEGAL years staying here and you needed to marry her to get your permanent status?

          My ex wife had the 14 cats, not me. My immigration status for the last 17 years is irrelevant to the discussion. I am NOT the husband of your friend. Angela, please refrain from posting any further on this topic, you are not adding anything intelligent or useful.

            I'm certain that neither you nor your wife had 14 cats! That's an exaggeration, like your insults this time, which are both defense mechanisms.

            You got some relief from me at first, but since you're probably a fraudulent immigrant this answer is helpful and intelligent for those in this forum who are legitimate.

            Fraudulent people make it much harder for the legitimate immigrants!
