    Greetings!

    I am an Indian citizen - lived in the US from 1990 to 2002, and during that time obtained a Green Card through my then employer on an EB2. My green card was given to me in March of 2001, with an expiry date of 2011. In 2004, owing to a phenomenal career opportunity in Australia, I moved out of the US to Australia. I've lived in Australia ever since, got married there and became an Australian Permanent Resident. Never once did I come back to US - not even for work. I didn't think too much about my greencard....although it was safely tucked away with a few other old IDs from the US.

    Earlier this year, in August, the Australian unit of the company that I work for asked me to move to the US to establish a new business line. They got me an L1A, a phenomenal package, and me, my wife and 2 sons are here now.

    I have a few questions, and I'd like your advice:

    1. My greencard doesn't expire until March 2011, but neither the Australian US consulate, nor the port of entry asked me to return it...despite my clearly calling out in my application that I had lived as a permanent resident in the US. Now that I am in the US, my family and I would like to continue here - and want to make this our home for the future - our sons are 4 and 2, and we're not keen on moving them anymore.

    2. My company is happy to file for my greencard as a multinational manager. I am happy to let them do it, but what should I do with my current greencard that does not expire until 2011.

    3. If I let my company apply for my greencard again, will this pose a problem?

    4. Is it too late for me to "on the record" return my green card? If not, how do I do it?


    Please advise.

      Your GC is invalid now as you have not maintained the permanent residence in US. Your lawyer should document the reasons well enough and ive you the next steps as people that have abandoned the GC in the past are to be scrutinized heavily as to why they had given up the GC in the past.

      Talk to a lawyer for proper guidance.

      2. The expiration date on the GC means nothing if you failed to maintain the permanent residence in US.

      3. It is complicated but can be done.

      4. No. You did not use the GC to re-enter but used a visa. The attorney should guide you through the proper channels.
