  • From green card back to Visa?

    Hi,

    I'm currently a green card holder and my status expires in 2022. I'm fully employed in the US, but I have a very generous flexible working agreement, so I spend majority of my time outside US with my family. I'm paying full US taxes (for the green card), but strictly speaking I'm breaking the law twice: first by spending more than 6 months outside US and second by not paying taxes in the country I spend 50%+ of my time. I've been doing this for the past 4 years and it is getting a bit much and I would like to regularize my situation, especially because my wife has now decided for sure she does not want to return to the US (for personal reasons). I would have hard time getting a citizenship given how much time I spend abroad and I also don't want to be paying US taxes after I retire. So, is there an appropriate visa for me? Something that would be compatible with having full time employment in the US, but only being there ~2 months in two-week chunks over a year and paying appropriate amount of federal tax and perhaps no state tax at all? I'm working in a very special sector and in general I am very happy with my job and would rather not leave it. Any advice would be very much appreciated.

    First, your status does not "expire". Non-conditional permanent resident status is permanent even if you don't renew the card. You can only lose the status by abandoning it or being deported. Second, there is no rule that you can't "spend more than 6 months outside the US". Abandonment of residency is a subjective determination that depends on many factors, not just time outside the US. If you wish to give up your permanent residency, and not be subject to the US taxes, you can file I-407 at a US consulate to voluntarily give it up. But I don't think there is a nonimmigrant visa for you to occasionally work full time in the US.

      how about putting GC on hold

      i possess a GC, but for the next 2 years, i will be stationed in my home country.
      should be returning to usa in 2021.
      can i request them to put my GC on hold for 2 years (till then, i will relinquish all benefits accruing as a GC holder)

          Thanks newacct for your kinda answer.
          auditorpine - for 1-2 years absence you can ask for a re-entry permit. Google green card re-entry permit.
