Clarification regaring EB1-C through H1B
Hi,
I would like to have the clarification on my GC processing :
Let me explain my situation. I was holding my H1B petition and my company sponsored Green card and they processed through EB2 and I got my I-140 approved as well, Since I am working as a international manager, I have requested my company to upgrade my case to EB1, and they suggested to go out of US for a year and come back, I am almost going to complete my 1 year cooling period out side US. My H1B extension is recently approved and I would like to know is it ok to come to US on H1B and process Green card under EB1 ? or does it have to be L1A?
Based on the current immigration situation & exception given, I would like to come in H1B, Please let me know is it possible to process EB1-C while on H1B visa. Please share if anyone come across similar situation. Thank for spending some time to read my situation and providing your valuable input.
