  • Advice Please - filling I-751 very close to the green card expiration date

I'm hoping someone here has been in a similar situation and can offer some advice. My husband's conditional green card expires on August 28th. It's been a very crazy summer for us and there was no way we could complete the application until now. We will be submitting the completed application on Monday. I'm super worried because I read that it takes 4-6 weeks to receive the 1 year extension on the green card while our application is pending. Even though the green card expires on the 28th, is it enough that we have submitted the application before then? I'm also stressed because my husband's driver's license expires on August 18th, and I'm also worried that this will impact his job. Has this been anyone else's experience? Any advice? I feel like we are totally screwed at the moment. Thanks in advance for your help.

It's the "received date" that matters. The application just needs to be officially received by August 28 for it to be properly filed. He won't have proof of permanent residency for a while until he gets the receipt, but that's fine as long as he doesn't need to leave and re-enter the US in the meantime. Try to avoid the border areas too.

If he used his 2-year green card to do the I-9 when he started his job, his employer is not allowed to re-verify him when his green card expires (it would be discrimination as they presumably don't re-verify US passports of people when they expire).

As for driver's license, that depends on the state.

This is my personal opinion and is not to be construed as legal advice.

Thank you both so much for your replies! That makes sense, and I feel a lot better about everything. Going to send everything out tomorrow and fingers crossed it doesn't take too long to get the extension.
