  • I-131 reentry permit question

    I am planning to apply for a re-entry permit for my mother who got her GC in Jan 2015.

    One issue I have is with her tax returns. I filed for her tax returns from 2017 onwards. No tax returns for 2016. I am not sure if 2015 tax returns were needed.

    The I-131 says the following:

    "Since becoming a permanent resident of the United States, have you ever filed a Federal income tax return as a nonresident or failed to File a Federal income tax return because you considered yourself to be a nonresident?"

    In this case what are my options? Of course I have to state the truth. So will the I-131 be rejected due to this?

    Can I retroactively fix this tax issue by filing her tax returns now?

    Please help.

    You should choose "No". No tax returns are required but your application will be rejected IF you choose "Yes".
