  • Mortgage on Expiring Conditional Green Card

    I was wondering if anyone has gone through a similar experience- I am in the process of purchasing a home with my US citizen spouse, but my conditional green card expires next month. I submitted my paperwork in august (received 8/5) but have not received the receipt notice that extends my status as of yet. My mortgage lender is asking for the receipt notice. I explained that USCIS is experiencing delays and that I have contacted customer service regarding this as well (have not heard back from lender yet). I received my biometrics waiver notice today- but still no receipt notice. Any suggestions on how to proceed without losing the home?

    Which lender are you using and are you using a direct lender or broker?

    I purchased a home with a local lender here in Massachusetts last May, with mine expiring this December and outside the window to apply for my conditions to be removed. They never even brought it up. I would shop around some lenders a little. You probably also want a lender that are direct lenders and not a broker. Not sure if this may be having an impact in your case.

      You mentioned you already received the biometrics waiver notice - so this means they already sent you the extension notice. The extension is issued first before they waive biometrics. I would double check with USCIS and perhaps ask them to resend you the extension notice.

        Thank you for your response. I was not expecting it to be an issue at this point (offer accepted, appraisal ordered), as I thought it would have come up during the pre-approval process. Also, my green card doesn't expire until a few days after the scheduled closing (which I understand could possibly be delayed). We had already signed some documents prior to them mentioning needing the receipt notice for the green card, so I am unsure if I would be able to shop around at this point. I have submitted everything I could think of (biometrics waiver notice, screenshot of online case status in my USCIS account, an email response to my inquiry from 9/22 regarding the missing notice which I just received yesterday after calling USCIS customer service), so hopefully they come back and say they can accept all that as proof that I have submitted a 'renewal'. Thank you for suggesting going to another lender- I will try to find out if I still have that option if all else fails.

          Thank you for your response. I had been reading that there were significant delays with the extension notice, so I was trying to wait patiently. Early on in September I called the USCIS customer service line and was able to get my receipt #. The agent told me that I would be able to print out the receipt notice using my USCIS account. I thought it would be easy enough to figure out, but it seems that this is only available if you filed a form online - which I751 is not even eligible for, from my understanding. I filed an inquiry about the missing notice on 9/22. I called USCIS again yesterday, they looked up my inquiry # and said I should receive a response by 10/7. They also suggested I print out the receipt notice online, and when I asked how, he said he did not have those instructions. I have tried every which way to figure it out but I am not seeing that as a possibility. Anyways, shortly after the phone call I received an update on my inquiry which said to 'please allow 30 days from the date of this correspondence for the notice to be sent'. Hopefully that means that the extension was generated at the time of the email and will be here within the next few days!

              Wow, that's definitely a problem. What bank did you borrow from? Many things depend on the bank and the conditions you took out a loan or mortgage under. I recommend that you turn to specialists. For example, when I had my parents take out a reverse mortgage, The most important thing is that you don't lose your home. I recommend that you urgently find a specialist who will solve this problem. Good luck!

                This is miserable situation, I advise you to have patience and nerves. The fact is that banks are very annoying when they need to collect a loan or mortgage fee, so they will find any way to get to you and collect a fee. I advise you to seek support from a consultant so that he will give you advice and time to extend the terms of your green card. If the behavior of the bank annoys you, then give them an unambiguous and affirmative answer on your situation and attach all evidence you have. I remember when I had a similar situation, when I was on the verge of losing my home, my only salvation was turning to Mortgage Advisor Bristol. Then they explained to me that banks have no right to request funds from you during such periods. Good luck to you, I wish you all the best!
