  • Boarding a United Airlines flight with expired green card and I-797

    Dear all,
i spent Christmas/New Years in Germany and am bound to fly back to the States tomorrow. I do, however, have an expired green card.

I filed I751 and have a I-797 stating that my permanent resident status is extended for 24 months from my GC’s expiration date.

It is my understanding that I can travel back to the US with the expired GC, the I-797 and my passport.

I called United to confirm if they would let me board but they weren’t clear and told me to enter as a German citizen which I don’t think is the correct way.

Now I am worried and confused. Did anyone travel recently in a similar fashion explicitly on United with their expired GC,
    I-797 and passport.

    TIA and Happy New Year.

There is no question that what you have is sufficient to board the flight and enter the US.

This is my personal opinion and is not to be construed as legal advice.

Did you enter the US successfully?

You may enter the United States for 24 months with your I-797 passport if you are automatically issued a green card. But you should check with the German consulate about this issue, so there are no problems leaving your country. I also encountered this when I used business flights 20 % and did not notice that my visa was expiring. But you can return home even with an expired visa passport. Document I751 must be submitted to the U.S. embassy to indicate that you have an expired visa and a stamp.
