  • Being outside US for over 2 years but ReEntry Permit still valid

    I've been staying outside US for 2 years + 3 months now as due to COVID restrictions, traveling back was becoming very difficult. In addition, I have been undergoing long term medical treatment which I didn't want to leave in the middle.

    My current 2 years Re-Entry Permit is still valid till March 02, 2022. Would that entail me entry back into the US or am I considered having abandoned the Green Card? I was reading on some US based immigration lawyers' websites where they mention that even with Re-Entry Permit, you are only allowed to come back to US within 2 years time. But on State Dept. and USCIS websites, they mention the validity of Re-Entry Permit.

    Can someone please let me know if this particular situation where my stays outside has been over 2 years but Re-Entry Permit still being valid, do I have chance to be admitted back to US?

    I think the only way to find out is that you travel before your re-entry permit expires. Good luck.

      Your re-entry permit means that when your return before it expires the base assumption CBP has tongavr is that you did not intent to abandon your LPR status. So you should arrive before it expires. You are looking a gift horse in the mouth.
