Is the 1 year abroad based on a single trip or is it cumulative of multiple trips

  • Is the 1 year abroad based on a single trip or is it cumulative of multiple trips

    My wife has a green card and she spent most of 2021 in Spain due to some unexpected complications with her pregnancy while visiting family. She was approx. 345 days outside of the US. We re-entered the USA in late December and we are wondering if we can travel abroad again in May for approx. 4 to 5 weeks. This 4 to 5 weeks puts us above a total of 1 year abroad but it is unclear to me whether it is a single trip that Customs and Border control review or if they look at multiple trips when considering abandonment of residence. We own a house in US and my wife is a stay at home mom.

    I would appreciate any insight anyone can provide on this matter.

    I understand is for a single trip lasting more than a year.

      Her pattern of spending most of her time outside the USA will eventually catch up with her. I wouldn’t leave the USA again until 2023

        U r saying until Jan 2023 or Dec 2023.. Actually i had trip of consectively 3-3 months in 2021 and when last time i entered the CBP officer stamped my passport out for 4 months .I just want to check can i travel to India in June for 3-4 weeks?

          January 2023 for OP’s wife. Your situation has been well addressed on VJ. Btw green card holders don’t have to show CBP their passports unless specifically asked. Next time you travel with a green card just hand CBP your gc.

            Congratulations you got enough people on VJ to erroneously tell you what you wanted to hear. One of peeps you are listening to cost saw his wife lose her green card because she was spending too much time outside the USA. Good luck.
