  • reentry permit - second time

    hello all:

    me,wife,child got lpr status(F3) in sep2018.

    wife,child arrived usa:10sep2018. (nj)
(since last 42 months: child hasn't left usa, wife visited india 2 times - for a total of 8 months)
(residing in my inlaws house. child is now an cpa. wife, child have jobs. wife, child filed returns last 3 yrs. i joint-filed returns in 2019)

i arrived usa (first visit after gc): 14sep2018. left usa: 03oct18
arrived usa: 20dec2018. left usa: 06mar2019
arrived usa: 30aug2019. applied & got reentry permit till: 25jul2022. left usa: 18jan2020
(reason mentioned in permit: still unfinished commitments/business,asset liquidation in india)
now, 'have' to visit usa before 25jul2022. after visiting, planning to leave in nov2022.
(still unfinished business/commitments in india. -most client offices being closed all of 2020 & most of 2021-).
    (i have a usa driving license,bank account,ss. but no business/job & nil usa income)

    1. will i gain entry (i understand, albeit never 100%sure) in jul2022 (before permit expiry), would they stamp my passport with any note.
    2. can i apply for a reentry permit the 2nd time. (in aug/sep2022)
    3. 'statistically/typically' does uscis approve the 2nd time too.
    4. will my reason 'still unfinished business', but wife/child in usa, still hold good.
    5. will any of my period (7 months) in usa be factored in for the 5yr citizenship mandate.
    6. when would my wife, child qualify for citizenship. (after 4+half yrs or after 5 yrs - since sep2018)
    7. does my wife, child would have to stay put in usa (must not travel) from may2023-sept2023 (last 6 months of citizenship mandate), for their citizenship.
    8. after getting citizenship, is there still any caveat for mandatory period stay in usa. can the cbp still deny entry post citizenship.
    9. after citizenship, if my wife/child travels out of usa for a prolonged period (of say 1.5-2 years), would it violate any usa residency/citizenship laws.
    10. if my gc gets revoked & after my wife acquires citizenship in 2023, can she sponsor me then for my 2nd time gc. if yes, what would be the wait time then.

    thank you

        4. I think so
        5. No, you need to be living in the USA for the 5-year requirement. Because you left 18jan2020 and will return more than a year later, you need to start your 5 year period again.
        6. They can start the process 90 days before 5-year anniversary. Visit https://www.uscis.gov/forms/uscis-ea...ing-calculator
        7. I read the requirements and I think is 3 months before submitting the documents. You can read the instructions for N-400 and the requirements by visiting https://www.uscis.gov/forms/explore-...naturalization
        8. Once citizenship is granted you don't have to live in the USA but need to meet all other aspects of citizenship like paying taxes on your income no matter where you live.
        9. No.
        10. Yes, most likely you will need to do consular processing and that can take a long time (varies so no timeframe).

          thank you Enub4:

          some clarifications though,

          query#5: is it again 5yrs or 4yrs.
query#8: post acquiring citizenship, if one does not own/rent a house and/or have employment, would the usa govt. revoke the citizenship.
(of fail to file returns, would they revoke)
query#10: is it a given, i WILL get the GC again, after my wife acquires usa citizenship & applies for my gc.('if' the 1st gc gets annulled by usa govt.)
query#10: '(varied so no timeframe)' - so could it even take 10+yrs (my existing 'F3' GC took 10+ years after the application was filed by my usa citizen father in law).
