  • Due to a re-entry permit expiration my DS-117 was rejected. What to do?

    Dear forum,
I lost my Green card due to staying out of USA for over 2 years allowed by my re-entry permit. I'm in South Korea. So I applied for a DS-117 which was also rejected in January 2020. My Re-entry permit expired in April 2021.
Is there any way to appeal?
I want to return to USA.
I had originally received my Green card in 2016 after a ten year long wait.
The Covid travel restriction started in July 2021. So I can't really use this as an excuse.
    Thank you
    Steppen

If you had a Re-entry Permit valid until April 2021, why didn't you return to the US on that in Jan 2020 instead of applying for a returning resident visa? Anyway, that is moot now.

Since you don't have a green card or valid Re-entry Permit, your only option is a returning resident visa, which you were already denied. Maybe if you could travel to Canada or Mexico, you could try to enter the US by land with a picture of your lost green card. Given the length of time you've been away though, you would almost certainly be denied entry, and you would probably not fare much better with an immigration judge in removal proceedings.

You would probably have to immigrate again from scratch.

This is my personal opinion and is not to be construed as legal advice.
