  • Staying outside of USA for 1 year and 18 days - Green card holder.

    Hi everyone,

I am a green card holder and due to financial and family issues, I will probably stay outside of US for 1 year and 18 days. What are my chances to be admitted back in?

    Thanks...

You should prepare for a secondary inspection. In secondary you will either be processed as an arriving alien and given a notice to appear or you will be processed as a returning f resident. If the former it will be after you are asked to sign I-407 and you refuse.

You should refuse to sign I-407.

Whst are the issues preventing you from returning to the USA now?

I have a similar question, however my time out of the US was a little longer....I am a GC holder and left the USA in Feb of 2018, and have not been back since....I now need to return to the US for business in 3 weeks....I assumed my GC would have been considered abandoned by now, so applied for an ESTA under the Visa Waiver program.....on the ESTA application I put my GC number where it asked if I had obtained a National Identify Card from any other country.....the ESTA has been approved, but I am still unsure of what might happen when I arrive at LAX?? I have never submitted an I-407 (to be honest it completely slipped my mind when I returned from the US back to Australia and never thought about it again), and some people have told me that I will find myself in trouble at the airport when I arrive.

Will I have any issues entering the US, as I have an approved ESTA that has my GC number on it? Should I take a signed I-407 and hand it to the CBP officer at immigration when I arrive?

Need advice please as I am quite nervous about this!!

      Thanks!
