I am a Green card holder (via Family Immigration - Spouse of a US Citizen). I was in US from Jan 94 to Oct 99 on Green Card. In 99 I returned to India and applied for a re-entry. My Re-entry permit was for 2 years which was extended for another two years. I visited US last in 2005 and my Green Card expired in May 2006. I have however not abandoned my green card and continued to file joint returns, and also maintain a bank account and 401 K account in US.
My husband is a US citizen and we moved back to India as he wanted to take care of his unwell parents. Though we had every intention of returning at sometime, we could not do so as my husband had to continue his stay in India.
Now we plan to go back to US again with our two children (who are also US citizens) next year.
What should be my course of action to renew my GC? Should I re-apply or will I be eligible to get a returning resident status and file for it? We live in Hyderabad now, so will i need to apply in Chennai?
