  • Travel abroad before Green Card Is in the mail

    Hi there,

Need some help with a situation. My wife got her immigrant visa approved and will be travelling to the states in December 2023 /January 2024 before her immigrant visa expires.

Then, she has to travel back home/abroad immediately for taking care of family situation. How can she do that because her green card may take months to get delivered via mail and she cannot wait!

Please help me!!! We are worried so much because she has to go back for brief period due to family situation. Appreciate the advice/help!!

When she uses her immigrant visa to enter the US, the immigrant visa automatically turns into a temporary I-551 (i.e. equivalent to a green card, which is also an I-551) valid for 1 year from the date of entry. She can use this immigrant-visa-turned-I-551 for all purposes that a green card can be used for, including working in the US, re-entering the US, etc., until 1 year after the date of her initial entry.

This is my personal opinion and is not to be construed as legal advice.

Thank you so much. This is very helpful, how does the Visa turn into I-551? Do they give her some sort of paper or document at the airport? Thanks again🙏

The immigrant visa has a line of text on it that says "upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year". The "endorsement" is the entry stamp received when she uses the immigrant visa to enter. Those things combined mean that she has an I-551 valid until 1 year after the date of entry.

This is my personal opinion and is not to be construed as legal advice.

Wow. Thanks for clarifying this. I feel much better.

Do you have any information regarding a rumor which says port of entry CBP guys stopped stamping passports when foreigners enter the US? Is it for other visa categories or all passports are no longer stamped? Just curious. Thanks again🙏 much appreciated!!!
