    Hi, thank you for taking a look and hopefully you can answer some of my doubts.

    I have been married to an abusive american husband for the past six years. He has been verbally, emotionally and physically abused my child and me for all these years. Particularly, he threatens to terminated my and my child's green card if any of his demand or request is unmet or if i decide to file for my own taxation documents. And if anything is done or carried out against his will, he will abuse my child and me.

    I would like to know if I decide to report his unspeakable acts and double face character to the relevant authority or agency, will my child's and mine greencard be terminated upon his request to the USCIS? My greencard is currently on overseas hold after submitting a petition to remove the conditional status 3years ago, as i have been accompanying him overseas as requested by his work location. My child has received his greencard under the stepparent adoption option.

    I am more concerned about whether my abusive husband has any jurisdiction over my child's greencard as he threatens to terminate his card so to prevent my son from going to Northwestern University this fall for his undergraduate studies.

    I am really sorry to hear your problem...i am not very much sure but i am wondering have you contacted the customer service of USCIS...do that....

    Just find out if you can file I-751 to remove the conditions on your and your child green card and get free from that person......

      I would say.
      Because yours is a bonafied marriage going for over 6 years, you don't have to fear of loosing your status.
      Based on what you said, You need to gather as many documents showing that you have a bonafied marriage, taxes, leases, bank statements, pictures,affidavits from friends, joint bills such as phone,utilities,cable,credit card, insurence,photocopy of your documents showing your comun address,magazin subscriptions, even junk mail coming with both names.
      This for just in case.
      But you are eligible to apply under the batter and abuse spouse and children.
      YOu however applied 3 years ago to remove the conditions.
      If that aplication was adjudicated, and you had been approved, you should be free to file for divorce.
      I personally believed ( very strongly) that you can divorced. At the minimum saparete.
      Just Make sure before do, that you have one or a few police reports of violence against you and if applicable have same medical reports shoing mental or phisical abuse.
