  • I-751 denied for failure to show up for biometrics

    well we recieved our letter of denial for failure to show up for biometrics. Well only problem is we never ever got notice. The letter states say your application is deemed and abandon and my wife's perminate residents has been terminated.

    We are both are steamed and outraged and dont know what to do. i called vermount service center and all they tell me to do what the letter states and apeal and file a motion to reopen under I-290b, another $630. they also asked me to do a Infopass and we went to speak with an officer.

    they told us that there is nothing they could do to reopen it, the woman was very nice and said we are better off to reapply again as it would be faster and if we tried to apeal it that it would take years to see the judge.

    please any input would help as this totally sucks we must pay again for something not our fault. why would we not show up for something so important.

        i have the similar situation with denial of my I-751 petition due to failure to appear at the local USCIS office for biometrics capture, but in my case temporarily i am staying overseas. i don't know what documentary evidence i can attach to support a Motion To Reopen. My wife, who is right now at home in the United States, called our local post office yesterday but they couldn't give any information regarding when that letter came to us. They don't keep that sort of information on file.
        So I am asking here for a good advice of what to do in this case. Did anyone have experience of sending a Motion To Reopen without supporting documents?
        ... also if anyone ever had an appointment for I-751 biometrics capture overseas?

          Failure to show up for Biometrics

          I forgot my biometrics appointment and realized this several days after the appointment. I read in one of the blogs that you can just show up at the center where you had the appointment and they will take you anyway. Indeed this is true. I showed up at the center today, four days after my appointment, and they took me without asking any questions. I was told by a person who works there that I could have shown up within 90 days of the appointment and it still would have been okay. I was frightened by the statement on my appointment letter that said if you miss your appointment, your application will be "abandoned." Apparently they do not believe you missed your appointment until it's been 90 days after your appointment. They also told me at the center that if it's been more than 90 days, you can reschedule. The people working there were very polite, friendly, and understanding. Most of them seem to be immigrants themselves.
