  • Please help! I am desperate!

    I don't even know where to post or start since I am in a real sticky situation.

    I moved to the US right after I got married in 1999.Got my GC through marriage and was working. Got divorced in 2005 and came back to India. Took a 2 year re-entry permit in 2006 which expired in 2008. My GC officially expires August 2012. During this time - I haven't gone back to the US since 2006, got re-married to an Indian and have a 5 year old child. while my ex husband has become a US citizen as a divrocee.

    1. Is my GC and SSN still valid?
    2. In case it isn't valid anymore (since my entry permit expired) what do I do? How can I activate my GC? and how much fees involved?
    3. Want to take my daughter and husband along with me to start afresh in the US? Will they be granted visas through me?
    4. My sister lives in the US with her son, would she be able to help in any way?

    I have so many questions, but I do not want to flood the enitre page. I would be greatful if someone...anyone responds.

    The short answer is - you're not a LPR anymore, nor have been one since your reentry permit expired in 2008.

    As you state, your GC is still valid in the sense that it hasn't expired. You have, however, lost your status as a LPR.

    There's nothing you can do. An LPR whose reentry permit has expired, which traveled outside the US with the intention to return, but was unable to do so due to reasons outside its control can apply for a SB-1 visa (returning resident).

    The US hasn't been your residence for at least five years, and you had no plans to return, until now. In any case - you've been out of status for almost four years.

    As you're not an LPR anymore, you want be able to get said status for them either.

    If your sister is a US citizen you could apply for immigration - F4 category. The priority date for F4 is now 2000 - ie, your sister was to apply for you now, your date may become current in 2024.

        There is not much you can do at this time, you lost your status in 2008 when your re-entry permit expired.
        The expiry date of 2012 on your physical GC does not mean anything, that date was valid if you were living in US then you would have to apply for another one after that date.
        If you want to visit US with your family you will have to apply as tourist and visit so as tourist.
