I was granted a family based green card in 2007. After that me and my husband travelled to Italy for a vacation and during that time he became ill. After several hospitalization he decided to move to the USA to get medical assistance and I stayed in Italy since he could not support me and my son. Now that he is stable he would like for me to get back to USA. My question is: could I apply for a returning resident visa? Or should he re-immigrate me again? Also, at the time we left my husband was in the US military, but has now been retired for medical reasons. Would this make any difference for USCIS when making a determination, since I would be following a US armed forces member? Please help me!!! thanks
